Open burning regulations

 

A permit shall be required for open burning. The permit may be granted by calling the Fire Station at 665-6001 in  advance of the burn. No permits shall be issued for parcels of land with addresses located east of M-14, in the Village of Dexter, nor shall any permits be issued on parcels of land of less than one acre in size.  The Township through its Fire Chief shall have the authority to prohibit any or all open fires when atmospheric conditions or local circumstances make such fires hazardous.

 

“Prescribed Burning” as defined in the ordinance is allowable under a permit. Structures and other materials may be burned for fire suppression training only in accordance with separate regulations as stated in Ordinance 2009-02..

 

Note: Cooking fires are excepted. 

 

Open burning shall consist of clean wood, natural materials, and dried vegetation including leaves and grass clippings.  “Clean wood” means natural wood which has not been painted, varnished or coated with a similar material; has not been pressure treated with preservatives; and does not contain resins or glues as in plywood or other composite wood products. Fires shall not contain rubbish, plastic, leather, or petroleum based material, nor shall they contain any flammable or combustible liquids.

 

Any open burning permitted under this Section must be:

                ~ Completely extinguished by 4 pm, attended at all times by a responsible adult,

                ~ Occur at least 50 feet or more from any structure, and

                ~ At least 50 feet or more from all property lines.

 

Open burning shall be conducted only during daylight hours and between 8 am and 4 pm.

 

There must be a means at hand at all times for controlling the fire, i.e., a water hose, shovel, and other such tools necessary to control the fire.

 

The Fire Chief or other designated fire official shall determine the duration of open burning. Under certain circumstances the fire official may grant an extended duration.

 

The Fire Chief or other designated fire official may prohibit any or all open burning which is or could be offensive or objectionable due to smoke or odor emissions when atmospheric conditions or local circumstances make such fires hazardous or objectionable.

 

The Fire Chief or other designated fire official may order the extinguishment of any permitted open burning which creates or adds to an existing hazardous or objectionable condition. The permit holder shall immediately cease open burning and extinguish the fire when directed by the Fire Chief or other designated fire official.

 

At the expense of the property owner the fire department shall extinguish any unattended, unpermitted, objectionable, or offensive fires.

                                                                                                                                           

Except for single-family dwellings, no charcoal burners shall be kindled or maintained on combustible balconies or within 10 feet (3 m) of combustible patios on ground floors,

Cylinders having capacities greater than 2 ½ pounds (1 kg) [nominal 1 lb (0.5 kg)] LP-Gas capacity shall not be located on balconies above the first floor that are attached to a multiple family dwelling of three or more living units located one above the other. (Except where balconies are served by outside stairways and where such stairways are used to transport the cylinder.)
