 Chair Ream called the meeting to order at 7:00 p.m.

Variance #1450, in the name of Fran Coy’s Hairstylists, Cornerstone Design, regarding property code #H-26-105-010, 418 S. Wagner Rd., request to allow expansion of nonconforming use, pursuant to Section l2.04.


Public Hearing open at 7:02 p.m.


Applicant/petitioner:

This phase of construction could be 30 x 40 not 2l x 40.  Storage is for staging of main building construction, approximately 3890 sq. ft.


MOTION BY COMMISSIONER AUTH, SUPPORTED BY COMMISSIONER HINSON TO CLOSE THE PUBLIC HEARING AT 7:05 P.M.

MOTION BY COMMISSIONER AUTH, SUPPORTED BY COMMISSIONER HINSON, IN THE MATTER OF VARIANCE #1450, IN THE NAME OF FRAN COY’S HAIRSTYLISTS, REQUESTING TO ALLOW EXPANSION OF NONCONFORMING USE, PURSUANT TO SECTION 12.04, BASED UPON THE FOLLOWING FACTS:


I FIND, UNDER ARTICLE 13, SECTION 13.06, THAT:


1.

THERE ARE EXCEPTIONAL OR EXTRAORDINARY CIRCUMSTANCES OR CONDITIONS APPLICABLE TO THE PROPERTY INVOLVED OR TO THE INTENDED USE OF THE PROPERTY THAT DO NOT APPLY GENERALLY TO OTHER PROPERTIES OR CLASS OF USES IN THE SAME DISTRICT; PROPERTY WAS ORIGINALLY COMMERCIALLY ZONED;

2.

SUCH VARIANCE IS NECESSARY FOR THE PRESERVATION AND ENJOYMENT OF A SUBSTANTIAL PROPERTY RIGHT POSSESSED BY OTHER PROPERTY IN THE SAME ZONE OR VICINITY; IN 1977 THE PROPERTY WAS COMMERCIALLY ZONED; IT ONLY BECAME INDUSTRIAL IN 1994.  

3.

THE GRANTING OF SUCH VARIANCE OR MODIFICATION WILL NOT BE MATERIALLY DETRIMENTAL TO THE PUBLIC WELFARE OR MATERIALLY INJURIOUS TO THE PROPERTY OR IMPROVEMENTS IN SUCH ZONE OR DISTRICT IN WHICH THE PROPERTY IS LOCATED;  VARIANCE REQUEST WILL HAVE NO ADVERSE EFFECT ON NEIGHBORS;

4.

THE GRANTING OF SUCH VARIANCE WILL NOT ADVERSELY EFFECT THE PURPOSE OR OBJECTIVES OF THE MASTER PLAN OF THE TOWNSHIP; THIS AREA IS PLANNED/ZONED FOR MIXED US;

5.

THE CIRCUMSTANCES OR CONDITIONS UPON WHICH THE VARIANCE IS BASED DO NOT RESULT FROM THE ACTION OF THE APPLICANT OR HIS PREDECESSORS IN TITLE;  APPLICANT IS THE CURRENT LAND OWNER


AND THEREFORE MOVE TO GRANT THE REQUEST TO ALLOW AN EXPANSION OF 6200 SQ. FT. OF A NON-CONFORMING USE.
